The Jackson County Prosecutor’s Office filed charges Tuesday against the man who reportedly tried to rob a restaurant supply store at gunpoint but was wounded when a security guard shot him.
Jerome Theus, 26, faces a number of charges including attempted armed robbery, aggravated assault and armed criminal action.
According to court documents, Theus walked into the Restaurant Deport at the 1500 block of West 12th Street shortly before 4:21 a.m. Monday. A shirt covered his face as he pointed a silver semi-automatic handgun at the security guard and the manager in the store’s office.
The security guard pointed his service weapon at Theus who told the guard, “Don’t do that,” court records said. The guard pursued the suspect as he tried to run away.
The probable cause details that during the chase Theus pointed his gun at the guard. Acting in self-defense, the guard shot Theus approximately 17 times, and several rounds wounded him.
As the shooting occurred, Theus’ getaway vehicle, a dark colored SUV, sped away. The suspect was quickly apprehended and transported to the hospital for surgery.
Officers recovered Theus’ weapon that was reported stolen out of Stafford County, Kansas.
Theus’ criminal history shows he is convicted felon who served time in prison for a 2007 armed robbery in Johnson County.
Theus remains in the hospital, and his bond is set for $75,000.
