KANSAS CITY, Mo. — 9ine Ultra Lounge and a gym in the same shopping mall are not allowed to operate for at least one week, according to court documents.

C&C Development on Thursday filed a motion seeking a temporary restraining order without notice, stating that “immediate and irreparable injury may occur before a hearing can be held on the motion.”

The order, which was issued around 2 p.m. on Friday, states that despite “multi-victim” shootings at 9ine Ultra Lounge in January and August, the club still is promoting events for Sunday and later in September.

On Jan. 15, two people, including the suspect, were killed and 15 others injured in a shooting that a witness said resulted from fights earlier in the night.

Four people also were shot in August outside of the club in an incident police said stemmed from an argument in 9ine Ultra Lounge.

Following the August shooting, a separate tenant in the shopping mall discovered bullet holes on his property, according to court documents.

Jerry White, who owns a motorcycle training school, showed a 41 Action News crew the damage to his business.

Also included in the order is the gym Do Work Factory 2.0. Court documents state that the facility does not enforce social distancing or require its members to wear masks -- as required by local governments -- to combat the spread of COVID-19. That, according to documents, “interferes with the community right of public safety.”

The order is in effect until 5 p.m. on Sept. 11, but will be reconsidered at a hearing on the same date.
