KANSAS CITY, Mo. — It will likely be weeks before the man accused of killing his sons and abducting his daughters is returned to Kansas.
Donald Jackson, Jr. is behind bars in an Oklahoma jail after state troopers pulled him over and took him into custody Saturday night.
Jackson is accused of killing his two sons and abducting his daughters. According to authorities, Jackson fled his home in Leavenworth with the two girls Saturday, which prompted an Amber Alert.
John Picerno, a criminal defense attorney, said how soon Jackson returns to Kansas depends on if he waives his extradition hearing.
"If he waives it, the process will begin to get him back to Kansas," Picerno said. "If he requests an extradition hearing, that'll be continued. Normally, you're looking at about 30 days or so."
Todd Thompson, Leavenworth County attorney, said the sheriff's department is working diligently to get their report to his office. Once that's done, Thompson will review it and decide if and what charges will be filed against Jackson. Once charges are filed, Thompson said they can begin the process of transferring Jackson back to Kansas.
"I would be surprised if [Jackson] made it back there in a couple weeks," Picerno said.
Thompson said he could not provide a timeline for when he expects to file charges against Jackson.
